1. General

1.1. The website is the official website of Village on the Cliff (hereinafter: “the Village”).

1.2. Every user of this Website declares that he has read the contents of this Terms & Conditions, and that he agrees unequivocally to all its provisions and conditions, and that he and/or anyone on his behalf shall have no claim and/or demand and/or lawsuit, directly and/or indirectly, against the Website and/or its owners and/or its managers and/or anyone on their behalf and/or the Village.

1.3. Part of the content of this Website is formulated in masculine language for convenience only, but is intended for both women and men alike.

1.4. The user declares that the information displayed on the Website and/or any part thereof is the exclusive property of the Village, that the Village holds the copyrights in the information and/or any part thereof, that he undertakes to use the information on the Website for his personal use only, and not to copy, photograph, duplicate, transmit, print or publish the information on the Website, whether owned by the hotel or by third parties, and/or any part thereof to any person and/or any body without prior written consent of the hotel, except for personal non-commercial use of the information.

1.5. The user undertakes not to make any distortion or other change to the information, or any action that could harm the correctness of the information and its reliability or the dignity or name of the Village as the copyright holder therein, or of any other party.

2. Risks and Responsibility

2.1. The user hereby declares that he knows that the use of the Internet site involves many risks, both because of the technology involved and because of human factors operating through the Internet.

2.2. The user is solely and fully responsible for any use he makes and/or will make of the information.

2.3. The information is for the user’s personal use only, and its use, including any reliance on it, is at the user’s sole responsibility. Among other things, the user declares that he is aware that the pictures displayed on the Website are for illustration purposes only, and that there may be differences between their presentation on the computer screen and their appearance in reality.

2.4. The information is presented on the Website “as is” and the Village is not responsible for the adaptation of the information to the user’s needs and is not responsible to the user due to his inability to use the information for any reason. The user alone shall bear responsibility for the manner in which he uses the information.

2.5. The Village does everything so that the information will be correct and accurate as much as possible, however the information does not purport to constitute a complete, full or detailed analysis of all the issues detailed therein. The information is general only, partial and based. The Village shall not bear any responsibility regarding any error in the information displayed on the Website, whether by the Village or by third parties.

2.6. The Village shall not be responsible for any damage, inconvenience, loss, expense or distress that may be caused to the user or his property (including hardware and/or software equipment of the user) or to any third party, directly or indirectly, due to entry into the Website and the use of its contents.

2.7. The Village shall not be responsible for illegal activity by any user on the Website or by any other party not under its control.

2.8. The Village shall not be responsible for changes made to the information by the user and/or by any other third party.

3. Booking of Accommodation

3.1. General

3.1.1. The user may use this Website only in order to make bookings and purchase services and/or receive information. It is forbidden to use this Website for any other purposes.

3.1.2. Booking a room at the Village is possible by telephone to the Village reservations center or via this Website.

3.1.3. Anyone booking a room via this Website is required to enter his personal details, including ID number or passport number and credit card number, as well as the details of all accompanying guests.

 3.2. Service Purchaser Details

3.2.1. When purchasing services via the Website and making the booking as detailed below, the user will be required to enter his personal details into the system.

3.2.2.The owners of the Website and/or any of its operators and/or any of its owners and/or any of its managers and/or anyone on their behalf are not responsible for an error made by the user in entering the purchase details, including an error in selecting the vacation package, date, number of beds and any other service ordered by the purchaser through the Website, and/or any responsibility, directly or indirectly, in the case where the purchase details are not received in the system and/or any technical or other problem preventing the purchaser from purchasing services through the Website.

3.2.3. Entering false purchase details is a criminal offense and legal action will be taken against those entering false details, including tort claims for damages that may be caused to the hotel and/or the Website and/or its operators and/or its owners and/or its managers and/or anyone on their behalf.

3.2.4. The user declares that he is aware that upon entering the purchase details he will be included in the Village’s database. The Village may use the purchase details for the purpose of improving the services it offers to the user on the Website as well as contacting the user via regular mail, email and any other means of communication, and adapting the Website to his needs and personal preferences.

3.2.5. Privacy limitation – the Village declares that customers’ credit card details will not be transferred to other parties.

3.3. Booking Procedure

3.3.1. The user shall enter the booking details on the Website.

3.3.2. When entering the booking details, the user will be required to enter credit card details, for security purposes only.

3.3.3.Payment will be made in full upon departure from the Village, in cash and/or by credit card.

4. Terms and Restrictions

4.1. The prices on the Website are in shekels and include VAT (except in Eilat), according to the VAT rate changing from time to time.

4.2. The Village may change at any time the terms of room booking and the package prices.

4.3. The Village may change the Website Terms from time to time without prior notice to the user. The hotel will publish the new terms on the Website and their effective date will be on the date of their publication.

4.4. The Village may close the Website and change from time to time its structure, content, appearance, scope and availability of the services and contents provided therein, and any other aspect related to the Website and its operation, all without the need to notify the user in advance. The user declares that he shall have no claim and/or lawsuit and/or demand against the hotel in this regard.

4.5. The number of places in the Village is limited and booking a room is subject to availability only.

4.6. No double promotions or discounts.

4.7. Room check-in and check-out:

*Check-in: 15:00–22:00.
*Check-out: until 11:00.
Early arrival and/or late departure is subject to prior approval of hotel management and involves an additional charge.

4.8.Infants and children:

* Definition:“Infant” – one whose age is up to two years, exempt from payment.
In the case of two infants in one family, one of them will be charged the full price.

4.9. Accommodation of children and youth under 18 will be permitted only when accompanied by an adult over 21.

4.10. This agreement shall be governed solely by the laws of the State of Israel. The exclusive jurisdiction for any matter related to this agreement and use of the Website is in the competent courts in the Haifa District.

4.11. The user is aware that the use of an Internet site by its nature may involve technical malfunctions.

4.12. E.&O.E. (Errors and omissions excepted).

5. Cancellation and Changes Policy*

5.1. In regular season and in bookings under NIS 5,000:

* Up to 14 days before arrival – no charge.
* Up to 7 days before arrival – NIS 100 per yurt.
* From 7 days until arrival – charge of the full booking amount and/or the part thereof that was canceled.

5.2. In peak seasons – July/August and Jewish holidays or in bookings over NIS 5,000:

* Up to 21 days before arrival – no charge.
* Up to 14 days before arrival – 25% of the booking amount and/or the part thereof that was canceled.
* From 14 days until arrival – charge of the full booking amount and/or the part thereof that was canceled.

*Unless otherwise specified in the price offer or booking agreement.*

6. Miscellaneous Provisions

6.1. It is forbidden to bring pets for vacation.

6.2. It is forbidden to invite additional guests beyond what is stated in the booking unless with the Village’s prior written consent.

6.3. It is forbidden to remove equipment from the guest rooms. Guests must bring private towels for water sources outside the resort site.

6.4. Smoking is forbidden within the Village except in designated areas.

6.5. The user undertakes to leave the kitchen in the facility clean and without damage upon leaving the place.

7. Preservation of the Place

7.1. The user undertakes, on his own behalf and on behalf of all other guests with him, to preserve the place and not to cause any damage intentionally and/or negligently to the site, including any equipment therein.

7.2. The user confirms that in the case of any damage, the above credit card will be charged with the full cost of the damage.
